In the Gadhavi case, the wife received 55% of the net property while the husband received 45%.

The parties were married for 20 years before separating in 2018. The husband (H), an investment banker, earned a substantial income, while the wife (W), a doctor, mostly worked full time. H stopped working for three years to care for their younger child needing 24-hour support. The marriage produced two adult children.

At the start of the relationship, the husband had assets worth $2,716,236 and the wife had assets valued at $375,000.

  • In 1999, H sold his home for $1.275 million and they jointly purchased a family home (FMH) for $2.05 million, which appreciated to $14.5 million by trial.
  • Both H and W earned high incomes through work or investments.

The property ultimately amounted to $24 million. Allegations of coercive and controlling behaviour by the husband later emerged, influencing the court’s decisions.

How Courts Make Findings on Family Violence

The primary judge found that during the relationship and after separation, the husband engaged in coercive and controlling conduct towards the wife and children, including several incidents of physical violence.

The husband’s counsel conceded the violence. The judge concluded that the wife’s contributions during the marriage justified a 60% share of the property, leaving 40% for the husband. A 5% adjustment favoured the husband under s 75(2).

The judge noted that the wife’s parenting became significantly more difficult due to the husband’s unacceptable and demeaning treatment of her and the eldest child ([220]).

  • The husband’s coercive conduct justified extra weight to the wife’s contributions, resulting in a 55:45 split. ([32]-[33])
  • The judge applied a holistic approach rather than isolating contributions, following precedents such as Benson & Drury and Steinbrenner.

Full Court Findings

The Full Court clarified that:

  • Section 79 discretion is values-based and not mathematical.
  • Contributions must be assessed holistically, not scored individually.
  • Courts cannot treat original contributions as fixed percentages of total wealth.

The Full Court set aside the judgment and remitted the case to another judge.
